HOW TO APPEAL MY PARKING INFRINGEMENT

Generally the City of Cockburn is unable to withdraw an infringement because of the following reasons: 

Your appointment went over time  

You lost track of the time

You took a phone call that was too important

You were only there for a few minutes over the allowed time

You did not see the sign

You didn't know the parking rules

You thought that you were allowed to park there

You did not understand the signage

 

There was nowhere else to park

You ran out of petrol.

 

Situations an Infringement could be successfully appealed with supporting documents are:

In certain situations, the City is able to withdraw an infringement once it has been issued. Infringements may be withdrawn in the following circumstances (supporting documentation must be provided):

Proof Needed

If your vehicle broke down and you could not move it.

RAC callout documentation or other evidence of mechanical failure must be provided.

If you were not the driver at the time of the infringement being issued.

Supply the drivers name and address details, complete the downloadable form.

Your disabled parking permit may have fallen from dashboard.

ACROD permit must be produced on request.

Immediate medical attention being undertaken or required by driver.

Medical certificate/documentation is to be provided.

Your vehicle was stolen or you were detained by the police.

Please provide the Police Reference Number.

HOW TO AVOID ADDITIONAL COSTS

Pay or appeal your fine within 28 days of the date of issue of your fine. If payment is not received within 28 days a Final Demand Notice will be sent to you with added costs and a further 28 days to pay the infringement notice.

If payment is not received in the next 28 days, your infringement notice will be registered at the Fines Enforcement Registry, which carries further costs and may effect licenses held in your name.

Before you park, ask yourself

              1. Is it legal to park here?
              2. Is it safe to park here?
              3. Will it inconvenience others?

 

Election to take the matter to Court

If you wish to have the infringement notice dealt with by a court DO NOT pay the infringement notice.
You should immediately (before the due date) advise the City in writing of your election to have the matter heard by a Court or complete the downloadable forms. (Infringement take the matter to court) - View Documents 

Do you still wish to appeal?- WHERE TO SEND YOUR APPEAL

Then you must do so within 28 days from the date of issue of the fine or further costs may be added.

This can be done by completing the relevant infringement appeal forms shown above and mailing or emailing them to:

Please remember to:

  • Retain a copy for your own records until the matter is resolved.

All appeals are lodged and processed through an appeal administration system and could take up to 28 days to process.
A letter of response advising the outcome of the appeal will be posted to you from Rangers Services.
