Question: What is the zoning for Mr Raayen’s property? nswer: The property is currently zoned ‘Rural – Water Protection’ under the Metropolitan Region Scheme and ‘Resource’ under the City of Cockburn’s Town Planning Scheme No.3. Question: He said he has been given the run around by the WAPC and Cockburn Council about when a decision will be made on the zoning. Which entity is responsible for the zoning? Answer: The State Government is the final decision maker for any rezoning proposals at both the local and regional level. The WAPC is responsible for zoning through the Metropolitan Region Scheme (MRS). The City of Cockburn is responsible for ensuring the Local Planning Scheme conforms with the MRS.
Question: When will a decision be handed down? Answer: The City is not aware of any MRS rezoning proposal that has been submitted to the WAPC by Mr Raayen or his surrounding neighbours. The area where the property is located was elevated from a Planning Investigation Area to an Urban Expansion Area by the Minister for Planning in August 2023. Prior to any local or regional rezoning in this area, a District Structure Plan needs to be prepared. This process is managed by the Department of Planning Lands and Heritage.
Question: Would Cockburn Council allow Mr Raayen to give shelter to homeless people in a tiny home or caravan on his property under current planning rules? If so how long could they stay there? Answer: Under current planning regulations, Mr Raayen is allowed to construct a single house and an ancillary dwelling on his property. An ancillary dwelling is a dwelling not greater than 70sqm and there are no restrictions on who can occupy an ancillary dwelling or for how long. abitation in caravans is regulated under the Caravan and Camping Grounds Act 1995. Under this legislation and the associated regulations, a landowner or someone authorised by them can live in a caravan on a property for no more than three nights in any 28 consecutive day period.
