Owner and Occupier Details
Request for information about owners, occupiers, electors and ratepayers
Section 5.94 of the Local Government Act 1995 outlines various types of information typically maintained by local governments that the public can request to inspect, subject to limitations specified in section 5.95 of the Act.
This information includes:
- Rates records (refer to section 5.94(m))
- Electoral rolls and registers of owners and occupiers (refer to section 5.94(s))
The process for requesting this information is established under Regulation 29B of the Local Government (Administration) Regulations 1996 - “a local government must not make available to a person copies of information referred to in section 5.94(m) or (s) unless:
- The request for the information is made in the manner and form approved by the CEO of the local government; and
- The CEO of the local government is satisfied, by statutory declaration or otherwise, that the information will not be used for commercial purposes.”
A commercial purpose is defined as the use of a public record for the purpose of:
- Sale or resale or the producing of a document containing all or part of the copy, printout, or photograph for sale, and/or
- Obtaining of names and addresses from the public record for the purpose of solicitation, and/or
- Monetary gain from the direct or indirect use of the public record.
How to request information about owners, occupiers, electors and ratepayers
A person can visit the City’s Administration Building during office hours and request to view, free of charge any:
- Rate record
- Register of owners and occupiers and electoral roll
The person may request copies of the inspected information, provided the person:
- States the purpose for which the information is being sought
- Makes a statutory declaration specifically stating that the information will not be used for commercial purposes by that person or another person.
The statutory declaration must be witnessed by an authorised witness in accordance with the requirements of the Oaths, Affidavits and
Statutory Declaration Act 2005.
Reasonable requests for a copy of a rate record, register of owner and occupier and electoral roll will be provided by the City free of charge.

You can submit the witnessed statutory declaration to the City in one of the following ways:
- In person at the City of Cockburn Administration Centre located at 9 Coleville Crescent, Spearwood between 8.30am and 4.30pm, Monday to Friday.
